Police Officer Will Not Be Charged For Killing Napster Exec While Texting And Driving — Because It’s Apparently OK For Police To Do That

Los Angeles County sheriff’s deputy Andrew Wood will not be charged for fatally running over former Napster COO Milton Olin Jr. in his patrol car while the officer was typing a message into his computer.

We first saw the news on Valleywag, but there is good coverage in the Daily News and LAist.

The instance exposes the different way that law enforcement officials are treated versus civilians in cases where a person is killed because of texting while driving.

It’s illegal to text and drive in California; the state has a specific law against it. Civilians caught doing it can expect to face charges. But a report from the Los Angeles District Attorney’s office shows that the rules may be applied differently to cops.

The incident involving Olin and Wood happened in December 2013 in Calabasas, California. Olin, a key figure at the peer-to-peer music-sharing company that pioneered the online music download industry, was cycling in the bicycle lane when he was killed instantly by Wood’s patrol car.

Wood drifted into the bicycle lane while typing a reply to a colleague who wanted to know whether any other officers were required to attend a fire reported at a high school he had just left. He was trying to tell the other officer that no further backup was needed.

The Los Angeles District Attorney’s report into the incident says that even though it is illegal to text and drive, Wood was not negligent because police officers are expected to respond quickly to messages from colleagues:

Wood had also been texting his wife from his personal phone minutes before the crash, but those texts were not thought to have contributed to Wood’s inattention while driving, the DA’s office said.

In a statement taken at the scene, Wood claimed that Olin had veered into his lane. The DA reported that the opposite was true.

Many of Los Angeles’ cyclists are furious at the lack of charges, according to the LAist. “To say biking advocates are unhappy with the DA’s decision to not press charges is an understatement.”

There is a petition to prosecute Deputy Andrew Wood on Change.org.

As New Year dietary fads go, giving up meat, dairy and fish altogether might seem extreme for the average person looking to shed a few pounds. Yet there are growing signs that 2014 could be the year that veganism – often viewed as the preserve of hippies, animal activists and health obsessives – stops being a niche dietary choice and gains new followers, and not just because of soon-forgotten resolutions.
This year will see the German supermarket chain ‘Veganz – We Love Life’ opening its first branch in the UK, offering over 6,000 vegan products. The store is hoping to take advantage of increasing interest in non-meat, non-dairy food, with celebrities such as Jay Z and Beyoncé among those to have reportedly tried adopting veganism.

Most UK supermarkets already stock vegan products, but Veganz is the first dedicated chain store of its kind in Europe. Set up in 2011, the company hopes to open a total of 21 stores across the continent by 2015 to meet growing demand.

The choice of not consuming any animal products at all is currently being promoted by Mark Bittman’s book VB6, which takes a “flexitarian” approach – advocating eating a vegan diet before 6pm.

“By going 100 per cent vegan I think people are missing the boat,” said Mr Bittman. “The question is not how challenging you can make your diet but how sane you can make it; there’s nothing wrong with animal products in moderation,” he says.

Telling fat people they ought to be thin is about as helpful as telling gay people they should be straight

This week a Boston-area doctor revealed  she will no longer accept patients who weigh more than 200 pounds, because fat people are dangerous deviants who should go to “obesity centers” to get treated for their “disease.” Earlier this summer, a gay man accused a New Jersey doctor of refusing to treat him because, allegedly, she attributed his need for medical care to “going against God’s will.”

“Homosexuality” and “obesity” are both diseases invented around the turn of the previous century. Prior to that time, being sexually attracted to someone of the same gender or having a larger than average body were, to the extent they were thought of as social problems, considered moral rather than medical issues: That is, they were seen as manifestations of morally problematic appetites, rather than disease states.

The same medical establishment that pathologized same-sex sexual attraction and larger bodies also offered up cures for these newly discovered diseases. Those who deviated from social norms were assured that, with the help of medical science, homosexuals and the obese could become “normal,” that is, heterosexual and thin.

In the latter half of the 20th century these frames were challenged by gay rights and fat rights advocates. Within these movements, the words “gay” and “fat” had similar purposes. They were intended to depathologize what medicine called “homosexuality” and “obesity,” by asserting that different sexual orientations and body sizes were both inevitable and largely unalterable, and that being gay or fat was not a disease.
